By continuing with the installation of WinCalendar, you agreed that you (and whomever is to use WinCalendar) accept the Terms and conditions for this which follows. When prompted, please indicate whether you accept or do not accept. If you do not accept these terms you must select 'NO' to cancel installation. WinCalendar is a customizable calendar/date picker & calendar creator for use in: Windows (Stand Alone) or Microsoft Word or Microsoft Excel. See below for more information. 'SAPRO SYSTEMS' is the duly owned company, which operates out of Florida (United States) which has created WinCalendar. 'USER' refers to any entity including a company or organization which uses, installs, distributes or handles WinCalendar. A copy of this USER agreement may be found in the installation directory under ‘agreement.txt’. This User Agreement applies to WinCalendar as of Feb 19, 2015 and is superseded if and when a newer agreement is available. 1) SAPRO SYSTEMS is proud to declare as with all of our software: WinCalendar does not contain any 3rd party advertisements. WinCalendar does not change/effect any file associations. As per responsible software development WinCalendar includes a un-installer. WinCalendar is not bundled with 3rd party software (besides required reference files - by Microsoft). 2) The free version of WinCalendar is free and may be reproduced and installed on an unlimited amount of PC’s, provided there is no charge for WinCalendar and no compensation is received for it. However, the USER may not provide WinCalendar as a download from a freely accessed web site or through any file swapping service. USER may not publicly distribute WinCalendar or any parts of WinCalendar without written permission from SAPRO SYSTEMS. 3) WinCalendar is owned & developed by SAPRO SYSTEMS and is protected by United States copyright laws and international treaty provisions. All rights reserved. USER agrees & acknowledges that the design of WinCalendar is owned by SAPRO SYSTEMS. The USER cannot reproduce the design or ideas of WinCalendar without written permission from SAPRO SYSTEMS. USER agrees WinCalendar program files cannot be reproduced for profit or parts distributed as part of another program. USER may not rent, lease, or resell WinCalendar without written permission from SAPRO SYSTEMS. USER may not modify the WinCalendar application code in any way. You may not reverse engineer, decompile or disassemble WinCalendar. 4) WinCalendar is a versatile Calendar program and can run with or without Microsoft Excel & Microsoft Word. However without both Word or Excel you will not be able to create a Calendar. In order to use WinCalendar integrated with Word or Excel they must already be installed before installing WinCalendar. Word & Excel is a product of Microsoft Corporation and not affiliated with SAPRO SYSTEMS. 5) SAPRO SYSTEMS derives its funding for WinCalendar from the portion of users that pay for a license. USER understands that until the USER elects to purchase a license, certain features & customization options are disabled, or provided as a preview only. A reminder message will display if not licensed. The frequency of the reminder message will increase with time since first installed. 6) The USER accepts WinCalendar 'as is'. SAPRO SYSTEMS assumes no liability for damages, direct or consequential, which may result from the use of WinCalendar, even if SAPRO SYSTEMS has been advised of the possibility of such damages. This limitation of liability and risks is further reflected in the price of WinCalendar. 7) Regarding the Ovulation/Fertility feature: This feature is based on various assumptions & should not be used to prevent pregnancy or as a guide to achieving pregnancy. Each woman's cycle varies & this feature may result in misleading information. Sapro Systems does not in any way warrant or guarantee the accuracy & results. This feature is provided 'as is', we strongly recommend consulting with a physician and/or other sources before acting on any ovulation & fertility data. 8) WinCalendar reflects Holidays for over 6 countries. SAPRO SYSTEMS shall not be held liable for any issues due to missing or incorrect holidays. USER agrees that refund requests for such issues shall not be permitted. Also note the displayed Holidays is limited in the free version of WinCalendar. 9) If any provision of this Agreement is ruled invalid, such invalidity shall not affect the validity of the remaining portions of this Agreement. 10) This agreement shall supersede any disclosures or statements posted on SAPRO SYSTEMS website for WinCalendar (www.WinCalendar.com). 11) USER may not use WinCalendar to create Calendar files for distribution from a publicly accessible website in any way such that it competes with WinCalendar's own Free Calendar web pages. USER also agrees not to create blank or nearly blank calendar files using WinCalendar for the purpose of distributing them over a file sharing service (i.e. Kazaa, Gnutella, Bitorrent, Limewire, etc...). THE USER AGREES TO THE FOLLOWING IN THE EVENT THAT THE USER PURCHASES OR HANDLES WinCalendar AS THE LICENSED VERSION: 12) WinCalendar License purchases are non-refundable... 13) It is the USER’s responsibility to run WinCalendar as the unlicensed free version (same install anyhow) before purchasing to: verify WinCalendar meets USER's needs; verify compatibility with the intended installation PC’s; verify compatibility with the USER's version of Microsoft Word and Excel; verify that the USER has sufficient resources to run WinCalendar (memory, hard disk space, etc.). USER understands and accepts that WinCalendar licenses are sold 'as is' and that License purchases are non-refundable. USER understands that it is the USERS's responsibility to ask any questions to clarify capabilities and features before purchase. 14) In case of any bug or defect: User must allow SAPRO SYSTEMS to provide support. User accepts that regardless of any bug(s) or defect(s) WinCalendar licenses are non-refundable, especially so if the defect was evident on WinCalendar as the free demo. In order for us to provide support USER agrees to email us detailed information and/or screen shots to illustrate the exact issue. User accpets that any refund requests will be rejected if USER has not permitted us to provide support or if USER has not adequately described/illustrated the issue so we can diagnose. 15) Unless otherwise stated or negotiated in writing, SAPRO SYSTEMS will provide six (6) Months email based support for the BASIC license and 1 year (365 days) email based support for the STANDARD and PRO license. The support period begins the license purchase date. Support includes any correspondence that requires a response from SAPRO SYSTEMS. In case of any support inquiries, USER must use the SAME email address used for purchasing (so that SAPRO SYSTEMS can identify the licensed USER). If the license is a multi-PC license, upon request the USER must provide info to establish that the USER is associated with the license purchaser and/or running a valid licensed WinCalendar. SAPRO SYSTEMS reserves the right to request additional information to confirm the license registration of the USER. Support may be refused if any information does not agree with license purchase data or it is detected that the USER is in violation of this agreement. Support does not include re-issuance of license IDs - except as specified in the next item... 16) The licensed WinCalendar program may be transferred up to Two (2) times to another PC or a new PC or re-installed on the same PC (in the case of a rebuild), provided that: USER agrees to first UNinstall WinCalendar from the old PC (while connected to the Internet) such that it is not installed on more than the licensed PC’s; AND the install file for WinCalendar version 4 is still available to the USER; AND USER retains the license ID number; AND the transfer installation is performed within five (5) years of purchase; AND USER retains the license ID number . In case the USER looses the license ID, SAPRO SYSTEMS can re-generate it upon request provided: the USER email us using the same email used for purchasing; AND the request is made within the support period - 1 year for Standard and Pro license, 6 months for Basic license. 17) Support specifically excludes each of the following: network installation related issues; Support for third party Add-Ins or USER Macros; issues related to other program which may interact with WinCalendar; Support for Microsoft Word, Support for Microsoft Excel, Support for Microsoft Outlook; Support for Virtual PC / Citrix issues; phone based support; Support specific to WinCalendar running on any future versions/patches of Windows, Excel or Word. 18) Support is non-transferable. SAPRO SYSTEMS will provide email based support to the email address associated with the license purchase only and only during the support period. SAPRO SYSTEMS may refuse support to a email address that is not associated with a license purchase. Further in order to respect the privacy of our customers, SAPRO SYSTEMS cannot assume that the purchaser of WinCalendar license(s) allows us to share order info with requests from other email addresses, even if the email is reflective of the same organization. For multi-PC license purchases only: SAPRO SYSTEMS may at our discretion provide support to other email addresses - if the request email address reflects the same organization as the purchase email (example from: aEmpolyee@licensedCompany.com). 19) WinCalendar may be installed in a Citrix or 'Virtual' type PC environments that allows for the potential of more than one user to run WinCalendar at the same time. For such a case a PC license is required for each potential simultaneous user. Example: if a Citrix environment or Virtual PC allows for up to 10 simultaneous users, then the purchase of a '10 PC' license is required. 20) Licenses come with free version 4 updates (version 4.1, 4.2... upto any version 4.99). To update USER simply installs the newer version - UN-install of existing WinCalendar version 4 not needed (and would remove the license). 21) USER understands and accepts that a internet connection is required to activate a license. As part of this process basic PC identification data and WinCalendar license data is passed to a script on Sapro System's website. In case USER does not have a internet connection, SAPRO SYSTEMS may provide the user with manual instructions for activation. USER agrees to provide a target PC Identification number to SAPRO SYSTEMS and any other related info as needed for this process. 22) WinCalendar will periodically (~1/Month) check for free updates upon using any part of WinCalendar. If a free update is available the 'About WinCalendar' dialog may contain a link to download it. As part of this version check WinCalendar and our web server may also confirm that the PC contains a valid license. In doing basic computer id data is transmitted through the internet. This mechanism may de-activate a license if it is detected that the license is not valid or that the USER is in violation of this agreement. USER understands and accepts that this version check mechanism is automatic when connected to the internet and cannot be disabled. 23) You may not disclose to others any discovered methods for enabling items intended for the licensed version of WinCalendar, nor may USER disclose to others the License ID for converting WinCalendar to the Licensed version. USER may not resell WinCalendar license without written permission from SAPRO SYSTEMS. In case of this or any violation of this agreement, USER is liable for compensation to SAPRO SYSTEMS including but not limited to: any estimated lost revenue + penalties + administration costs + legal expenses. 24) Related to the Timeline (Gantt) Layout in Excel: USER understands that the Gantt Layout is provided 'as is' and has a precision of 1 full day (an appointment lasting say 1 hour will display as taking up the whole day). USER understands that the Gantt layout is provided as a STATIC layout - meaning User changes to dates and other inputs on the Excel generated file will not trigger updates on the plot area.
